Terms of Service
The terms under which IV Digital Pro provides this website and its services. Clear obligations in both directions.
Agreement
By using ivdigital.pro you accept these terms. If you do not accept them, please do not use the site. These terms govern use of the website itself; work we carry out for clients is governed additionally by a separate written proposal and scope, which takes precedence where the two differ.
Our services
IV Digital Pro provides web design and development, e-commerce development, search engine optimisation, paid advertising management and related digital growth services. The specific services, deliverables, timeline and price for any engagement are set out in a written proposal agreed before work begins.
Quotes and pricing
Prices shown on this website are starting points for the type of work described and are not offers capable of acceptance. A binding price is only created by a written quote issued after a discovery conversation. Quotes remain valid for thirty days unless stated otherwise. Prices are in US dollars and exclude third-party costs such as hosting, domain registration, premium plugins, stock media and advertising spend, which you pay directly.
Payment
Projects normally begin on receipt of a fifty percent deposit, with the balance due on completion and before final handover. Larger engagements may be split into agreed milestone payments. Ongoing retainers are invoiced monthly in advance and may be cancelled by either party with thirty days written notice. We reserve the right to pause work on overdue accounts after reasonable notice.
Your responsibilities
Delivering on time depends on both sides. You agree to provide content, access, approvals and feedback within the timescales agreed in the proposal, to ensure you hold the necessary rights to any material you supply to us, and to nominate a single person empowered to approve work. Delays caused by outstanding materials or approvals may move the schedule and, where material, the price.
Intellectual property
On receipt of full payment, ownership of the final deliverables produced specifically for you transfers to you. We retain ownership of our underlying tools, frameworks, libraries and general know-how, and of any preliminary concepts not selected. Third-party components such as plugins, fonts and stock media remain subject to their own licences, which we will identify. Unless you ask us not to, we may display the completed work in our portfolio.
Revisions and scope
Each proposal states the number of revision rounds included. Work outside the agreed scope is quoted separately and only carried out once you approve it in writing. We will always tell you before something becomes chargeable rather than presenting it afterwards.
Warranties and limitations
We provide our services with reasonable skill and care. We correct defects in our work reported within the support period stated in your proposal at no charge. We do not warrant that the website will be uninterrupted or error-free, nor that any particular commercial outcome will be achieved. Specifically, we do not and cannot guarantee search engine rankings, advertising returns, traffic volumes or conversion rates, as these depend on factors outside our control including third-party platforms, market conditions and your own offer.
Limitation of liability
To the extent permitted by law, our total liability arising from any engagement is limited to the fees you have paid us for that engagement. We are not liable for indirect or consequential loss, including loss of profit, revenue, data or business opportunity. Nothing in these terms excludes liability that cannot lawfully be excluded.
Third-party services
Our work may involve third-party platforms and services such as hosting providers, payment gateways, advertising platforms and analytics tools. Those services are governed by their own terms, and we are not responsible for their availability, changes to their functionality, or their pricing.
Confidentiality
Each party agrees to keep the other party confidential information confidential and to use it only for the purposes of the engagement. We are happy to sign a separate non-disclosure agreement before you share anything sensitive.
Termination
Either party may terminate a project engagement with written notice. If you terminate, you remain liable for work completed up to that point and any non-refundable third-party costs already incurred. On termination we will hand over completed and paid-for deliverables.
Website content
Content on this website is provided for general information. Examples shown in our portfolio are concept designs created by IV Digital Pro for demonstration purposes and do not represent client engagements unless explicitly stated. We make no representation that the information on this site is complete or current, and we may change it without notice.
Changes to these terms
We may update these terms from time to time. The version published on this page at the time you engage us is the version that applies to that engagement.
